Divorce

The termination of a marriage can involve complex legal issues such as the division of marital assets, the custody of children and the determination of child support and alimony. The procedure is commenced by filing a divorce petition which generally alleges irreconcilable differences. The spouses must then wait at least six months before they can be divorced. The spouses are free to remarry after the divorce is finalized.

The divorce process is an emotional process with critical family and financial implications. We would be happy to meet with you and provide you with a free initial consultation and guide you through this process.

  Annulment

In certain circumstances, it is possible to annul a marriage rather than have a divorce. An annulment voids the marriage which means that the marriage never legally existed. This may be advantageous as it avoids religious restrictions and the social stigma of divorce.

  Legal Separation

Another option is a legal separation which enables spouses to divide family assets and make arrangements for child custody and support without undergoing a divorce. This enables spouses to obtain a formal resolution of their affairs without having a divorce. Although spouses are not free to remarry others after a legal separation, this arrangement may be beneficial if the spouses are unhappy residing together but they are not ready to get divorced or wish to retain benefits of marriage such as health care insurance. Further, a legal separation can be beneficial if the spouses do not wish to divorce for religious reasons.
