A Will is a written document that provides instructions for the disposition of a person’s property after his or her death. It is to important to have a Will because, not only does a Will allocate your property in accordance with your wishes, it also permit you to specify the person you trust to administer your estate and it enables you to select a guardian for any minor children left behind.

It is important to not procrastinate in your estate planning as may not have time to arrange your affairs later. In addition, you may later develop an illness or require medication that may preclude you from preparing a Will. A Living Trust is a document that specifies how your financial affairs will be handled if you become incapacitated or die. The process of establishing a Living Trust is more complicated than drafting a Will. However, unlike a Will, a Living Trust does not need to be probated at death which avoids the lengthy probate process and costly estate taxes. Rather, your debts are immediately paid at death and your possessions are transferred to your beneficiaries according to your instructions.
